Seller wants the rating changed and threatens to sue if this is not done
Summary: A participant initiated a discussion about a seller who is requesting a change in their review and threatening legal action if the request is not fulfilled. lidor3073 added a comment, implying that the seller should not be throwing accusations when they have their own issues. The topic appears to reflect frustrations with the seller's approach to handling reviews.
The situation is as follows:
Last Sunday I won a motherboard at auction and paid for it immediately afterward.
After I sent the seller a message, he said the shipping would still not happen, and the message still had NOT been answered by the time I left my review.
I then rated as follows:
Item will NOT be shipped; apparently the sale price is not as expected. Then don’t offer it as an auction! No reply to PMs. Since the item was actually supposed to arrive by tomorrow at the latest but hasn’t even been shipped yet, WITHOUT showing any reaction at all, there is a THICK, RED rating.
On Thursday evening, then, a response in the form of a message from the seller:
Hello XXX,thank you for the purchase. Sorry, I had completely forgotten about the items.I’ll take care of everything tomorrow.VGAlexander
Then on Friday there was still no reaction by evening, and no tracking number had been provided by then either, so I opened a case: "Item not received".
Today at noon I get a request to change the review with the following content:
"Hello Erich,I sent you back the requested amount as a gesture of goodwill. I’d like to apologize again for the inconvenience. I would like to point out that you bought from me with binding effect and you are obliged to pay.I responded to your message within one day. Your review is completely exaggerated and inappropriate. I kindly ask you to revise this review. I will send you the corresponding request for this. Please note that you only have 10 days to process the review; after that it is no longer possible.I want to be upfront. I make an annual turnover of around 2,000 euros on eBay. Your review has a negative effect on my sales and my turnover. If you do not change the review at least to a neutral one and do not remove your accusations and false statements, then I am forced to file a lawsuit and claim corresponding damages from you.Kind regards"
In short:
A private seller makes €2,000 in sales a year. Well, that may be true or not, because the seller only has about 20 ratings, and one of them is my negative one.
Can anyone give me a reasonable reason why I should change the review? And what exactly in my review is a false statement? And what does a private seller want with damages?

If you're a seller living in a glass house, you shouldn't throw stones.

·7 months agoSo now you've changed the rating and you don't even have the goods yet?
I would have waited until the goods arrived.
You don't have to be intimidated by emails like that.

What REQUESTED amount did he refund to you as a goodwill gesture?
Watching with interest.

·7 months agoAh .... apparently it also slipped past you that the 15th is a Sunday and the 16th and 17th and in Cologne even the 18th is CARNIVAL. Even here in the HS district and in MG, at least on Monday the 16th, everything except the discounters outside was closed.

·7 months agoI really have nothing to do with carnival, and while I do notice that things get crazy in this region during carnival, I wouldn’t assume that nothing is open except discount stores.
Although the OP handed out the red card too hastily, that could have been handled differently.
The threat of legal action was unnecessary; they could have spared themselves that.

That was the 19th...

·7 months agoI think it's wild that someone can just leave such a bad review.
Not even the deadline set by eBay for the delivery date had been reached yet,
and not all sellers are available online 24/7.
No one wants buyers this impatient!

·7 months agoHi @ehham47
Unfortunately, you still haven’t answered @bootyooty’s question about exactly when you rated.
The seller has set a processing time of 3 business days in their listings, i.e. they would have had to ship by Wednesday. It is well known that the delivery times stated in the listing by Ebay are estimated very optimistically.

·7 months agohello @ehham47
then in the ratings, where it says "Received as seller" on the right, sort by newest and you will see that your seller has already received 685 ratings.
Since you didn't know about this eBay setting, I'm going to assume you're still a relatively inexperienced user.
You have 60 days to leave feedback; it's not the center of life, and if you're frustrated you shouldn't leave feedback either, only once you've calmed down a bit.

I would also have waited with the review until the delivery period expired.
As far as the review is concerned, you have nothing to worry about, even if a letter from a lawyer should arrive. Some lawyers go along with any nonsense.
The seller has not fulfilled his obligation to deliver if he does not deliver the item.

·7 months agoWhat does that have to do with the fact that the seller "only" has 20 ratings as a seller? 🤔
And sales volume probably isn’t relevant to the problem either?
WHEN exactly did you leave the rating?
Do you also know that the delivery time is always only "approximate"?
I allow every seller the possibility that they may not be online sometimes for various reasons, but that doesn’t mean I immediately give them a negative in their profile, especially not when I want the item.
Of course, a case can be opened after the latest delivery date has passed.
Please clarify all further matters yourself with the seller, eBay can’t step in there, and whether a lawsuit for review removal would even be filed is questionable; and besides, couldn’t you just wait calmly for now?

OP7 months agoThe delivery deadline was by Thursday at the latest; it looks like part of it was accidentally deleted while editing, and unfortunately, editing it afterward isn’t possible

·7 months agoNo, it wasn't.
The estimated! delivery date was Thursday at the latest.
That’s not set in stone anywhere, it’s not guaranteed and it’s also not promised.
It’s just an estimate - from Ebay.
Unfortunately, Ebay here is calculating with data that in some cases is nothing more than wishful thinking.
