could use some help.
I bought an item from a commercial seller and it wasn’t delivered, with an excuse that there was no stock in the Czech Republic.
The seller never wanted to deliver because apparently I bought it too cheaply.
For business, more sellers sell on eBay and have this item in stock!
A liar who does not want to deliver the item.
What really annoys me now is that I created a request or case and eBay simply closed it with a refund.
I specifically checked the box saying I still wanted the item.
What is that supposed to mean!

OP2 months agoThe rating is the plain truth.
In my eyes, he’s a fraud because he does sell these programs with other accounts or seller names. Only with me did he maybe accidentally put too low a price and simply didn’t want to deliver for that.
But well, I’ve handed everything over to the lawyer. Because I don’t have to put up with something like that.

I still think it's a shame that sellers on eBay can do whatever they want.
In my example, simply not wanting to deliver. In my opinion, the seller should get a demerit point for that or be warned once in a while.
But fine, just close the topic, because I didn't get legal protection for nothing.

But your rating may be deleted (if the seller reports it), because it violates the rating guidelines.

your response is not helpful at all.
You did not understand me; the seller does not want to send me the item I bought at the price I paid for it.
Because he may have set it too cheap.
The way you closed the case is a real pleasure for the seller, since he no longer has to send it to me so cheaply.

It is a valid purchase contract that the seller must honor.
I did not want a refund, but the item. I also stated that in the request with an explanation for you. But eBay makes it very easy: refund and close the case!
I can't even file a complaint or appeal now.
But fine, there are other ways through my lawyer.
Because I won't let the seller get away with this. He even wanted to offer me 20 euros if he were allowed to cancel the purchase with my consent. The seller is simply a liar and these are fraudulent intentions on the seller's part!

Then use those ways, buyer protection only means that you get your money back. Everything else may gladly be clarified with the seller and outside of that!
And that it’s not supposed to be helpful for you is already clear to me because you don’t get to read what you’d like to read! Ebay is not your tool of execution!

EXACTLY for that, because buyer protection applies in cases of "item not received," "item does not match the description" and ultimately "the seller does not comply with their return conditions," and that's it.

You can report the seller to ebay
and you can also, if necessary, sue for fulfillment of the purchase contract between YOU and the seller, but ebay does not guarantee deliveries here because the contractual relationship exists between you and the seller.
ebay grants you buyer protection in the form of a refund and has therefore fulfilled its obligation.
Everything else is up to you.

Many thanks for your post.
In a case like this, we can only ever offer you a refund of the purchase price; the seller provides the item itself and only they have access to it.
Please contact them again and ask whether a new purchase of the item is possible there.

·1 month agoEbay interferes in almost everything and wants to control everything, but no one has any rights. The seller doesn’t ship the item privately, and when you write to support, the AI comes back with answers like maybe the item is still on the way or check the tracking information - what tracking information if it wasn’t shipped. Or contact the seller - of course I already did that before I turned to ebay. I’m supposed to chase after the seller’s details - you can contact us again in 3 days.
If I didn’t pay for an item, ebay would be quick to come down with sanctions against the buyer, but bad sellers can do whatever they want. For me, it’s over now after 21 years.
The good ebay days are long gone.
