Item purchased in May but never shipped eBay guarantee expired

Hello everyone,
In May I bought an item. The seller then wrote to me straight away that he no longer had the item at all, or had already sold it elsewhere. He didn't know how to cancel the purchase; it was his first sale on eBay.
I explained to him back then how he could cancel it and unfortunately then forgot to keep following it up. To this day there has been no reply, no delivery, and no purchase cancellation. The eBay guarantee for return or non-receipt has now expired.
I don't have the seller's name, so I can't file a criminal complaint. The only option left to me would be a dispute through PayPal. However, I'm worried that my eBay account could be blocked because of this.
The amount involved is €400.

Mentor2 weeks ago@wannab91 Hey. 🙂 Your user account will definitely not be blocked because of a payment dispute. You absolutely don't need to worry about that. Unfortunately, the deadline for our buyer protection has long since passed, so I have no way of helping you with this.

Mentor2 weeks agoThe "worst" that can happen, and will probably happen for sure, is that eBay can no longer help you because the buyer protection on eBay has expired.
With PayPal, you have buyer protection for up to 180 days, and the only thing that happens is that eBay can no longer help or is no longer allowed to help once the payment provider has been involved. In your case, that would actually be totally irrelevant because eBay won’t help or can’t help anyway.
