Fraud through a fake tracking number and buyer protection doesn’t apply
Summary: deinkamerashop24 reports a fraud case on eBay in which a shipment tracking number addressed to the wrong address was used to confirm delivery of an expensive camera. Despite clear evidence, eBay initially denied buyer protection. bootyooty recommended getting in touch again in order to get support from an eBay employee. mia@ebay then informed deinkamerashop24 that the buyer protection case had now been decided in their favor and that a refund would be issued in the coming days. deinkamerashop24 thanked everyone for the support and was pleased about the good news.
After I bought a camera on eBay for just over €500, shipping was unusually delayed at first, but after a little over a week the UPS tracking finally became available. On the day of the scheduled delivery, the shipment was then marked as delivered too, but no package had arrived at my place. After a short conversation with UPS support, it turned out that the tracking number provided was not for my name and address. So I called eBay, and they advised me to declare the item as “not received.” In the meantime, I also received written confirmation from UPS that the tracking number did not go to my address, but to another address with the same postal code. Kind enough, UPS also provided me in writing with the address that was on the label. It is a retail store in my town. I was also able to find out via a reverse image search that the images used came from Craiglist and were uploaded there in February of this year. So from that point on, it was clear that this was fraud.
After a few days I received an email from eBay support saying that the case had been decided in the seller's favor because they had provided a valid tracking number. I then replied to that email confidently with my evidence, and I received confirmation of my appeal. A few minutes ago came the disappointment. Despite the evidence I had provided and the written confirmation from UPS, the case was decided against me again. That makes me seriously wonder whether this “eBay buyer protection” really exists at all.
Has anyone had any experience with how to win a case like this, or are you at the mercy of scammers with no protection at all? I found various reports online saying that it is enough if you can prove that the tracking number did not go to the given address. That now seems not to be the case anymore.
In the end, as a commercial seller with “eBay Top Service,” who pays eBay four-figure fees every month, I lost a fraud case against a completely new account, even though I was able to provide written proof from the shipping provider that the tracking number in question did not go to my address. It just feels absurd.
Does anyone have a tip or advice on how to proceed now?

OP3 weeks agoGood morning, many thanks for the quick response. After the failed appeal to eBay by email, I saw that I could also file an appeal directly with eBay in this case. Of course, I did that too, and this appeal is still open at the moment. If a staff member there can help me further, that would be great. The case number is 5386488692.
Best regards
