Fraud cannot be reported
Summary: gewitterundhagel reported difficulties with a purchase where, due to a description they felt was misleading, a lid was missing. After a complaint became problematic because the seller had already opened a case, gewitterundhagel eventually found a way to report the case to eBay externally. A discussion arose about who is responsible for the misleading product description, with bootyooty pointing out that the description and the image suggested the missing lid. gewitterundhagel criticized the communication and eBay’s role in resolving such issues.
I want to report a purchase that I would like to cancel based on a false description. That’s not possible because the seller has already opened a case themselves. eBay is refusing to send the report. What can I do? From my point of view, this is strategy and fraud.

OP2 weeks agoPlease excuse me, I’m new to the community and thought you were an Ebay employee.
I was looking for someone who could help me with the complaints process. Apparently the ebay system is configured in such a way that you’re completely shut out when the seller opens a case. You can’t open a case yourself. Great, right?
Also, you don’t get any info about why the seller complained. I only found out the reason when an ebay employee closed the case. I appealed that, but that wasn’t accepted either. What was I supposed to do? The seller refused to accept the return, I incurred costs of over €30, and I had no way to make use of buyer protection.
Great trick for all sellers: if the buyer has a problem, quickly open a case! That gets you off the hook
But you’re right, why am I even bothering with the case. I’ll leave that to a lawyer. Luckily, I have legal expenses insurance.

OP2 weeks agoIt was not clear from the title of the listing that the lid was missing. You confirmed that. So please ask the seller to clearly state this defect in the description.
You are fixating on the term fraud. I expect ebay to ensure that the seller provides a clear description of the items. Instead, you side with the seller and excuse his misleading description as "unfortunate" or a "translation error". You shift the responsibility onto me as the buyer and expect me to clear up ambiguities?
That makes it pretty easy for you as a sales platform.
Why then does the seller refuse to accept the return if he is a reputable seller?

Mentor2 weeks agoI’m not part of the sales platform and I don’t work for eBay either, so I’m not just making things up. I also certainly am not telling your seller to do anything, I by no means excuse your seller’s behavior, and I reject such insinuations.
And yes, buyers here don’t just have rights, they also have obligations, including reading and understanding a product description as well as using the “Ask the seller a question” function if anything is unclear. You don’t have to take your frustration out on the volunteer helpers here in the public community. As for the alleged fraud, YOU brought that up in the OP, so I’m not the one making a big deal out of it, you are.
I’m merely expressing my opinion here and looking at the various issues from multiple perspectives. I also never confirmed anything, but rather pointed out what could have been done differently when listing it.

Also, it is clearly obvious in the photo that the lid is crossed out with a red X.
It is pointed out that you should carefully check the photos and description.
In the seller’s terms and conditions, it explicitly says that the "cover" = lid is missing.
So where exactly is there a "false" description, and how on earth is this supposed to be fraud?
Rather an unfortunate wording, or the seller should have written "without lid" in the headline, but I see NO strategy here and certainly no fraud!

OP2 weeks agoBy "coverage" I don't mean a lid. I agree with you that in the case of defective goods, the defect absolutely must be stated in the description and a picture is not enough. From my point of view, that is misleading the buyer.

Mentor2 weeks agoThere was a picture AND "cover missing". Maybe a translation error, but to accuse someone of intent and fraud, that just doesn't fly! Fraud is established by a court, and so is deceitful misrepresentation.
BTW, as a buyer you can also ASK questions before making a purchase if anything is unclear, but you surely know that already.

What kind of case did the seller "set up"?
That there is no lid on the Römertopf was stated in the order confirmation.

OP2 weeks agoThe description says "one-piece" and further down "cover missing". From that, I could not infer that the lid is missing. In my view, the picture does not replace a description.
I have no idea why the seller opened a case. He had offered to take back the Römertopf, but then refused to accept it. As a result, another €30 in shipping and return shipping costs to Poland were incurred.
I had to find out that I cannot open a case if the seller has already opened one. Only after a long search did I find a way.
In my view, not a reputable seller.
