Dear ladies and gentlemen of Ebay, dear Ebay community, I have the following problem. On March 20 of this year, I sold a model car through Ebay, via bid or price suggestion, which I accepted. That made the sale legally binding. Around 6 hours later (I have securely saved all exact data. So these can be presented or viewed at any time.) the buyer, presumably via this function specially provided by Ebay for that purpose (so the buyer doesn’t have to do much work, I suppose?), asked to cancel the purchase. He had not paid yet (not even to this day) and the item had not yet been shipped and still has not been shipped to this day. Since I was busy with something else at the time (my right, and sometimes that’s just how life is), I only dealt with the matter about 2 days later (but it wasn’t even a full 2 days.). I rejected the buyer’s request. (My right! I might have decided differently if the buyer had written to me (nicely) and asked me to. But he didn’t, as already mentioned.) This rejection was also confirmed to me by Ebay. (I have also secured the corresponding proof of this.) Only through my own research, because of this matter, did I discover a page on Ebay where reasons are given that supposedly entitle Ebay to comply with a buyer’s request to cancel a purchase even if the seller does not respond to this request. Apart from the fact that I find this deeply hostile to sellers and not serious, I also have serious doubts that this is based on a legal foundation. However, I have not yet examined this legally or had it examined. I will still do that. But even if that should be legally correct (then my trust in our legal system would really be completely destroyed. Because if a sale has come about, then it has, regardless of what the respective sales/purchase platform says about it, right?), that Ebay can do that, according to the aforementioned Ebay page, after three days already(!), then with not even a full 2 days, I was still well within the time! But no money came, and I wrote to the seller here via the messaging function. He even replied to me, contrary to expectations, because before that he hadn’t contacted me at all. His reply was arrogant, cheeky, threatening, defamatory, and also coercive - that’s how I see it anyway. He accused me of criminal acts and made himself criminal as well. He also threatened me with the legal department of his company (which he named, although I don’t know whether I can mention it here!? But it is a large German automobile manufacturer, which by the way is located about 350 kilometers away from the place of residence he listed here. I already find that highly suspicious.), if I continued to insist on the complete completion of the sale or purchase. He also said that I probably hadn’t noticed that the sale or purchase had been canceled, but that I had taken almost 2 days to reject it............... in order to make the sale happen at any price! The good man, who is apparently an amateur lawyer with no legal expertise, but who likes to threaten people with the entire legal department of the company in which he claims to work, apparently doesn’t even know when a sale or purchase has (legally) come about and when it hasn’t. He really threw Section 355 of the German Civil Code at me, which, according to my research, cannot apply to private sales/private sales, especially not on Ebay. I reported this message of his to Ebay and actually did receive a reply. But a fairly general one. Supposedly Ebay imposed some consequence on him, but I don’t know which. I only know that the user is still accessible on Ebay. I have now written to him again, replying to his horror message. I also generally described the case to Ebay and/or reported the user. But to this day I have received no reply. Ebay only processed the response from him that I reported, somehow. Otherwise I haven’t heard anything further from Ebay. By the way, this is not about a lot of money here (and fortunately I’m not financially hanging by a thread), namely “only” 70 euros, but it’s the principle for me. Especially now that Ebay simply canceled the sale, after not even 2 days - and even though no money had yet been transferred and the item had not been shipped. Where are we headed with behavior like this, from Ebay and also the buyer?
