eBay has finally closed my case, even though I can prove that medimops delivered two books too few and that I am in the right — what other options do I have now to get my money or the missing goods?
Summary: kaufbeuren2009 reports a problem with an eBay order from a seller where two of the five books ordered are missing. Despite evidence such as the shipping weight and a written confirmation of the partial delivery from the seller, eBay closed the case. A reply from gebraucht-ist-gut suggests the case may have been misclassified and explains eBay’s standardized return rules. kaufbeuren2009 is frustrated because the proposed solutions are of no practical use and complains that eBay buyer protection does not apply. The discussion ends with the conclusion that further steps outside of eBay are needed in order to receive the missing goods or a refund.
Here’s the situation:
I ordered a total of 3 different items from the seller medimops on Ebay under one order number:
Item 1: a set of three books / Item 2: one book and Item 3: one book
That makes a total of 5 books ordered.
For my order mentioned above, there is a tracking number on file, with which “allegedly” all five books were shipped.
In total, I only received 3 books: one book from item 1 (two books from item 1 are missing). I received the two books from items 2 and 3.
Of course I contacted medimops immediately: I felt like I was communicating with the AI in an endless loop X times, and the AI kept claiming that I had received the shipment in full, since in medimops’ system 5 books are marked as shipped. So I am being portrayed as a “liar” and fraudster - sorry, the AI didn’t actually say that, but in the end that is exactly what it is claiming - medimops’ system is always right....
At some point I then opened a case.
I submitted the following evidence to E-Bay:
The weight of the shipment sent by medimops is printed on the envelope and exactly matches the weight of three books - I provided photos (I weighed the three books I received...). - Received three books - ordered five books - two books missing
I even have written confirmation from medimops that my order was shipped in two separate parcels - so apparently there are two shipments. medimops has not been able to prove the second tracking number so far:
After an endless loop with Momox’s AI, I went through the route of “Messages to seller”.
An employee at Momox sent me the following message (source: Momox’s reply can be read in my messages: "Updated by: Irina Jmukhadze, Sept. 23, 2026, 4:16 PM CEST Hello eBay - kaufbeuren2009, thank you for your message! We’re sorry that your shipment is incomplete. But don’t worry, the missing items are already on their way to you – we had to ship your order in multiple parcels.Thank you for your understanding and we hope you enjoy your items! Best regardsYour medimops service team
medimops never actually provided this “second” shipment - to this day I have only received 3 books, but paid for 5.
What more does Ebay want? That should actually be enough.
Even the seller admits that there were two shipments.....
Ebay ignored all arguments and evidence (including that the seller admits they sent a second shipment, but cannot provide a second tracking number) - and finally closed my case and my appeal.
By the way, this is not an isolated case - I took a look at medimops’ reviews.
Anyway: by now it’s not even about the few euros anymore. It’s about fairness and decency for me -
I can clearly prove that I am in the right - and even then buyer protection doesn’t apply.
And the best thing was Ebay’s last reply: I should just send back the books from item 1, then I would get my money back anyway
Seriously?! - how is that supposed to work if I didn’t even receive the two books from item no. 1.
So, if anyone knows of a higher authority I can contact - please let me know.
It just can’t be that as an honest buyer you get so “ripped off” and can’t do anything about it.
By now I open parcels I buy on Ebay immediately in the presence of the postal worker - at least then I have a witness.....
Many thanks to everyone who has an idea of what I can do next
PS: if the amount were higher, I would sue for my rights - but since the legal fees would clearly exceed the amount in dispute, no court would take the case..... - and that is now my personal opinion: medimops is counting on exactly that, that at some point you say: oh well, never mind - I give up.......

Mentor1 week agoYou should have just reported an incomplete item / not as described.
Then you probably opened the wrong case if eBay closed it (item not received maybe?).
eBay simply can't check exactly what was delivered under the tracking number - it only sees that it was delivered.
So return the incomplete item for a refund.

OP6 days agoThanks for the answer. It’s just not helping me any further.
- send back the incomplete article??? So I’m supposed to send back only that one book, (even though I supposedly received three books, but two books are missing, which I can’t send back anyway ????) And then I get my purchase price back????
Sorry, that’s a bit beyond me now.
And even if I were to send back that one book - in the end I’m the one left holding the bag. Right now I have one book (even though I paid for three books). If I send back that one book now and, assuming I then get my purchase price back - then I’d still have to buy the three books again - and I’d end up paying for the three books about 4 - 5 times as much as the original purchase price was.
What kind of logic is that? And what about our good old BGB: Priority rights of the buyer in the event of incomplete delivery (subsequent performance)
Subsequent delivery: The buyer can demand that the seller deliver the missing quantity immediately (§ 439 Abs. 1 BGB).
Cost neutrality: The seller must bear all costs incurred for the subsequent delivery (for example transport) (§ 439 Abs. 2 BGB). [1, 2, 3]

Mentor6 days agoHello,
Yes, of course you have the rights.
But you may have to enforce them yourself outside of eBay.
On eBay there are (unfortunately) only rigidly fixed rules and procedures.
And with an incomplete item, here it is simply only return for a refund, or the seller arranges a partial refund for it.
Agreements outside of eBay’s rules are of course possible - but then, if in doubt, it has to happen without eBay.

OP6 days agomany thanks for the reply,
Being in the right and getting justice are two different things. Especially when it comes to a large corporation like medimops. Even though I’d love to file a complaint and take my claim to court - firstly, that would cost too much money and secondly, it would probably come to nothing. So the wiser one backs down - in this case, me. I left a negative review and thus joined the ranks of buyers who had similar experiences with medimops. I’ll handle it like they did and buy from other retailers from now on.
Thanks again for the support.
