eBay buyer protection activated and won the case, seller threatens to sue
Summary: bibock1985 reports that they used eBay buyer protection for a damaged item and received a refund. The seller is now threatening to sue, claiming they were defrauded. bibock1985 is unsure whether they should respond to the threats, especially since the seller did not provide a return address and is supposedly moving. A legal guardian advises them to ignore the threats. Another participant notes that a lawsuit may be possible in the EU and recommends consulting a lawyer, since no legal advice can be given in the forum.
I opened an eBay buyer protection case because of an item that was partially damaged and won. The seller was asked to arrange the return shipment for me and did not comply with the request. eBay informed me that the refund had been approved and initiated, but now I’m getting a threat from the seller saying he wants to sue me because he thinks I stole from him.
How should I behave now?
Should I reply to the message or ignore it?
Of course he should get the goods back, no question, but if he won’t even send me an address where I should send the item, that’s going to be difficult. The address label is somewhat damaged and I’m not sure whether I can read the faded writing correctly. He also claims to be in the middle of moving.
Since the seller lives in France and I’m in Germany, would a lawsuit from him even have any chance of success?
I’m really unsettled right now and don’t know what to do.
My legal guardian says I don’t need to worry about it, because she thinks he’s bluffing and wouldn’t even be able to get a lawsuit through, but I’m still afraid of what might be coming my way now.

Why wouldn’t it? As far as I know, France is also in the EU.
And if your supervisor tells you something like that, then listen to her. You’ll see what may be coming your way. Furthermore, we’re not allowed to give legal advice here; contact a lawyer.
