eBay closes plagiarism case despite ongoing evidence preservation – how can that be?
I want to describe my current case because I no longer understand eBay’s approach.
I bought a lot of watches through eBay, and after receiving it, serious doubts arose about the authenticity of several watches presented as branded goods. After its own review, eBay even explicitly informed me in writing:
„After reviewing your case, I’ve determined that you received a counterfeit item.“
eBay then demanded that I provide solid proof of the counterfeit and set a deadline for this.
I am currently obtaining exactly this proof: one of the watches in question is with a jeweler for expert inspection. A written appraisal or corresponding report will also incur additional costs for me. In addition, the matter has now been reported to the police.
I explicitly informed eBay by phone that the review is underway. I was assured that the deadline set would remain in place.
Nevertheless, the case was then closed in writing. The reason given to me was that only one appeal per case is permitted and that further appeals would no longer be considered.
This is exactly where I no longer understand the system:
eBay prohibits counterfeits and replicas on the platform. In a specific suspected case, eBay demands that the buyer provide solid proof. To do so, the buyer may have to hire a specialist company or expert at their own expense. However, while this required proof is still being prepared, eBay closes the case for good and says that no further documents will be considered.
How is a buyer supposed to provide solid proof of a counterfeit under these circumstances at all?
I find it especially contradictory that eBay first confirmed to me in writing that I had received a counterfeit item, then requested additional evidence, and then ended the case before that evidence could even be completed.
I would be interested to know whether other buyers have had similar experiences with eBay Buyer Protection in suspected counterfeit cases and how you proceeded in such cases.
