Fraudulent return and Ebay's ignorance: a personal experience

I recently had a buyer purchase an expensive server. A week after arrival, that buyer requested a return. As commercial seller, I was legally obliged to agree. The buyer sent the server and the additional items back in two packages. What I received was a massively damaged server which had obviously fallen to the ground. The packages didn't look, though, as if they had fallen. Both packages contained damaged goods pointing to the same issue: massive physical shock. I reported that buyer to Ebay for fraudulent return. That report got acknowledged, but nothing else happened. While I was waiting for the appointment with my lawyer, the buyer asked for the refund. I confronted them with the damages, sent pictures and my reasoning, why I believed that they had caused this. The buyer immediately accused the transport company to have caused this. But there are good reasons, why I don't believe that. The next day, the buyer opened an issue with Ebay for not having received the refund. Ebay almost immediately decided to refund the whole money. After talking to the lawyer, I sent in my objection to the decision based on the fact that the buyer had returned damaged goods. I sat down for a good while, wrote my detailed statement and included photos. The next day, I received the message, that the original ruling stands and an additional statement as some kind of explanation.
Ebay support basically told me, that if I cannot find the return shipment, I should ask my neighbours. Yes. Ebay support hadn't even read my objection, nor do they seem to care at all. I never said that I hadn't received the shipment. I clearly stated that it had been damaged. I have since then sent two messages to express my frustration and point out, that their answer is completely besides the issue. No reply. Of course.
And to top everything: They kept the transaction fee (I didn't get it back). And I'm pretty sure that the return label Ebay gave the buyer did not insure the packages to its full value.

Edit: Above, I originally cited the answer that Ebay gave me. One of the moderators apparently removed that (IMHO) condescending and ignorant statement I received by Ebay Support that completely missed the issue at hand.

I mean, how hard can it be reading the objection and show me that you read it instead of continuously proving the opposite? To be honest: It actually reads like AI generated slop.

apart from the dilemma of not being understood by eBay…. your lawyer will certainly explain to you that you are the ones with the burden of proof. And I don't think that you can prove that the buyer damaged the goods, and when.

OP3 weeks agoI am aware of the legal situation and I think that I can prove it. But that's not the reason for my frustration here.
