a seller is not responding to the legal warranty because the item I bought is defective.
Ebay itself isn't able to help

as already written, dealers do not provide a warranty; the manufacturer does.
Dealers only offer a statutory warranty. You can claim this through Ebay buyer protection within the specified deadlines.
After that, only the payment service provider you used can help, or, if they are no longer responsible, your own initiative

Mentor2 weeks agoSellers don't give warranties, only manufacturers do that. And eBay isn't responsible for buyers' consumer rights.
