Reason for two refunds
Summary: friedrich19502009 asked about the reasons for the reversal of returns for a rescue rope and a winch that were involved in an eBay case with an online shop. perfect-sally and miriam@ebay explained that eBay had ruled in favor of the buyer and that the public prosecutor could request information if needed, depending on the request and its legal basis. miriam@ebay confirmed that both cases were decided in line with eBay's Buyer Protection policies. this is about the return issue from March 2024 (a recovery rope and a winch) from the shop oline-xxxxx.
According to the date (12/04/24 20:52) in the public prosecutor’s file, Mr. S. from H., operator of the ebay platform online-xxxxx, stated on the ebay review profile platform that he had filed a criminal complaint in the matter.
eBay had (according to a copy dated 12/04/24 from the public prosecutor’s file) decided to refund me the amount for the recovery rope and the winch, with the reason, I quote from the ebay letter
„The original decision will be upheld, as we have valid proof that the item was sent back to you.“
This applies to the recovery rope; the same eBay decision must have been made for the winch.
In this matter I had provided ebay with my DHL tracking numbers in March/April 2024, and also apparently the two delivery records showing that the winch and the rope had been delivered to Mr. S.
My question:
1. Can I learn the reason for the decision from ebay?
2. Can the public prosecutor’s office learn the reason for the decision if asked?

Hello @friedrich19502009 and thanks for your contribution! As you already write, both buyer protection cases were decided and closed in your favor in accordance with our buyer protection guidelines.
As part of an investigation, the public prosecutor's office can request relevant information about an eBay buyer protection decision. Which information eBay can or must disclose depends on the specific official request and its legal basis.

for 1: I don't think so
for 2: if an official request comes from the public prosecutor's office, eBay would be obliged to provide information.
The only question would be whether such data is stored for that long or has to be stored.
I'll pass it on to an eBay employee, she will get in touch here. However, she may need further info from you.
