Package was never delivered - buyer protection is being denied

Hello,
I ordered something, and after 1 week I received a tracking number for a package that had been delivered a day earlier. In my same town, but not to me, a few kilometers away. It’s a foreign tracking number - looked up for the same town. The package was never intended for me.
A police report has been filed. UPS has confirmed to me that this package was never intended for me or my address. The details (weight) also do not match the contents.
Ebay is refusing buyer protection because they think the package was delivered.
An appeal was rejected immediately, and all other employees say that after a rejected appeal, no new one can be submitted.
Maybe the community has some tips.
I was always told in advance that my purchase was protected. And now I’ve fallen for a scammer - by the way, there are now several negative comments with exactly the same scam, but ebay acts as if that’s all correct.

I received a reply. But unfortunately, apparently no one at Ebay really reads the messages or the attachments. I sent along all the evidence, a report + statement directly from UPS (that it never arrived with me and wasn’t my package and had a completely different recipient), etc.
The reply was:
Since I have received my package, I should select "Return this item" in the dropdown. But I don’t even have an item. I did reply again just now, but it’s frustrating 🙂

OP2 months agoExactly, the name was on it, it wasn't mine. I found out the street from the UPS hotline (completely different end of the city), I even went there in person, talked to the person, and they had only received their own packages.
In writing, I got confirmation from UPS once again that neither the name nor the address matches me. On top of that, I ordered something weighing about 500 grams and the shipping slip says 17.7KG. But unfortunately ebay doesn't care much... and they say "tracking number was delivered anyway".

With Klarna you have buyer protection for up to 120 days, with Paypal even up to 180 days after payment.
You may still be able to open a case there, provide the police diary number right away and point to the profile.

OP2 months agoI paid by credit card. Whether the credit card provider can charge it back is questionable; they need 45 days for review. It says on the internet that the chances are low.
