Hello everyone,I need your advice on a case involving a counterfeit game module.What happened:I bought a bundle of old Game Boy/GBA games (total price €104), listed as “various games from an old collection, all functional.” The main reason for the purchase was Pokémon Ruby (Game Boy Advance).After receiving it, it turned out that the Pokémon Ruby is not an original Nintendo item, but a reproduction/counterfeit. This was proven by several features in direct comparison with a genuine GBA module from the same delivery:black epoxy “glob-top” chip instead of a cased Nintendo mask ROM- no Nintendo board marking, standard AMIC memory- standard third-party screw instead of Nintendo security screw- different housing and coarse, blurry label printThe process:I opened a return case for “item not as described” and sent the counterfeit module back with tracking – receipt by the seller has been confirmed. I did not receive a refund. The seller apologized in case it was a fake and said they had not recognized it. I only wanted to return the counterfeit and keep the remaining genuine items. eBay closed the case and rejected my appeal.Now the seller has their full money and even their counterfeit back again (which made up over 50% of the value)I have now called eBay customer service and described the case: and the nice lady actually told me verbatim on the phone: “Selling counterfeits on eBay is allowed, and it is not a problem for eBay that buyers are thereby robbed of goods and money.” She even briefly consulted with a supervisor, and that is what she is supposed to pass on to me. My questions for you:- What avenues have you used (PayPal buyer protection, rights holder, consumer advice center, criminal complaint…)? I have now also opened a PayPal case.- How does eBay generally assess such repro/plagiarism cases?
