Hello dear people,
I have the following problem.
A buyer started a return, I can’t reject it because the item is allegedly not as described.
The buyer purchased a Switch 2, listed as new and in original packaging in the auction. It is.
He complains that the Switch 2 is not sealed. It isn’t from the factory either, and that was not described in the auction; it only says new and in original packaging.
He also doesn’t like the invoice because there is still a game on it and important data for me has been blacked out. That’s not a problem for the warranty, that part isn’t blacked out.
The auction was stopped by eBay afterwards because of some activity in the buyer’s account, but everything had already been completed by then.
So all this only occurs to him after 2 weeks, since the device was meant to be a gift.
Now he wants to send the device back with the reasons mentioned above.
Kind regards
Silberfuchs

Mentor2 weeks agoTag @silberfuchs321 return label to the buyer, process the refund after the return and inspection, if you don't do that, eBay will refund it for you from your money and you'll also get a defect entry in your eBay account

OP2 weeks agoHello,
this is totally unfair!
In my opinion, the buyer has no right to that. I’m not to blame for the missing seal, since it’s not shipped that way by Nintendo. And how am I supposed to know that it wasn’t used to play football for the last two weeks?!
Best regards

Mentor2 weeks agoMoin @silberfuchs321
whether that is fair or unfair depends on the realities of the individual case.
In any case, when selling on eBay Germany, the Buyer Protection applies, and by listing items you also agreed to its application:
eBay Buyer Protection applies in the following cases:
The buyer has not received the item
The item received by the buyer does not match the listing description, because, for example, the following applies:
the seller sent the wrong item or
the item arrives broken, damaged or otherwise defective
The seller does not comply with the return conditions stated in the listing
After that, if the customer opens a case, you must at least provide them with a return label.
If you don't do that, eBay will step in and then you may end up losing both the money and the goods.
If you can prove that your item was used excessively or that the reported defects are not present, you can deduct part of the refund amount:
Kind regards from the Baltic Sea

OP2 weeks agoHello,
Nothing was faulty. There was nothing about it being sealed in the auction. Just new and boxed.

Mentor2 weeks agoThen contact customer service by phone, or write in the opened case that there is no seal from the factory included with the Nintendo packaging.
You have already sold Nintendo 3 or 4 times within a few months, plus brand-new iPhone, Samsung and Macbook.
If you buy to resell, then you need a business registration.
