I am asking you to review this case, as I do not agree with the seller’s resolution.
I successfully won three separate items from a commercial seller through eBay auctions. I won all three auctions and then paid for them properly. In addition, I bought two other items from the same seller. All five items were paid for together and were shown as shipped and delivered under the same tracking number.
However, after receiving the package, I had to find that it contained only the two additionally purchased items. The three items I won were completely missing.
I contacted the seller via eBay and asked for an explanation of where my three won items are. However, the seller did not provide any explanation, but merely informed me that he had arranged a refund for these items.
I then explicitly told the seller that I do not want a refund, but rather want to receive the three items I won and paid for in the auctions. I did not receive any further response to this.
In addition, I found that the seller relisted the same items on eBay after the refund. The items are being offered again individually as auctions. The photos and items are identical to the items I won, with only the condition now stated as “Used”.
I therefore ask eBay to review this matter. For me, it is not just about a refund, but about the fact that an auction that had already successfully ended and a completed purchase were not fulfilled, even though the same items are then offered again.
I ask for clarification and for a review of whether the seller is obligated to deliver the items I won in the auction.

I can very well understand that the situation with your seller is annoying for you. If it helps, I’d be happy to contact your seller on our end and let them know that you’re still interested in receiving the missing items.
If no joint solution can be found and you want to insist on fulfillment of the purchase contract, I recommend that you find out about your legal options.

Mentor1 month agoIf the items not received were refunded, then for eBay the matter is settled! If you want the items, you can take action against it outside eBay.
