Copyright infringement of my photos, report to eBay unsuccessful so far
Summary: namdokmai reported that her sales photos were used by another seller without permission, and that her reports to eBay were initially unsuccessful. Another participant, petersmodellbahnstuebchen, offered help, while perfect-sally pointed out eBay’s VeRi program. namdokmai tried to protect her photos with legal threats and reported that the other seller’s listing was eventually ended. For her, this highlighted the importance of taking legal action in cases of violations.
Hello. Two personal sales photos of mine in one of my earlier sales listings were stolen by another PVK for her sales listing. I do not consent to the use of my personal sales photos.
I notified the PVK of this 3 days ago, or 78 hours ago by now, and asked her to remove my photos from her sales listing, but she is ignoring it. Since then I have also reported the copyright infringement to eBay, sending my original photos, but eBay has not yet deleted the photos from the seller’s sales listing. Does anyone know what else I can do so that eBay deletes the photos immediately?

Mentor1 month agoSince you apparently are a private seller, a report to eBay won’t help much! Try registering with the VeRi program, maybe that’ll do something.

OP1 month agothanks. I already did that, but twice it didn’t arrive on eBay complete, as I sent it.

please just tell us the item number of the offer you complained about. Then we can ask an eBay employee to check it.

"After legal advice, I would like to point out once again that you are using two photographs I took in your current eBay listing without my consent.
The photographs are images created by me and are therefore protected by copyright (§ 2 UrhG). The use and public display in your eBay listing took place without my permission and constitutes an infringement of my rights (§ 19a UrhG).
I already asked you on 07/07/26 to remove the photos. So far, I have received no response from you.
The use of my photographs is documented. The original files are in my possession, including any technical image information available (e.g. date taken, camera data, and image size), which proves that I am the author.
I hereby once again ask you to stop using my photographs immediately.
If you continue to use the photos without my consent, I reserve the right to assert my claims under § 97 UrhG. This includes, in particular, the review and, if necessary, legal enforcement of claims for injunctive relief and damages due to the unauthorized use of my photographs.
This message also serves as documentation that you have been informed of the lack of consent for the use of my images."
About 30 minutes later, her listing was ended. "Seller ended the listing because it contained an error."
Once again, this showed how important it is, if necessary, to announce legal action with sellers who are so uncooperative.
