    You’d better think again about your alleged status as a private seller! What you’re doing here is not private!

    That already starts with the food items, and on top of that the labeling requirement is missing!

    And your other offers are surely not private either. Cease-and-desist letters are expensive!


    You typically act as an entrepreneur or commercial seller if you:

    • buy items in order to resell them

    • sell items that you have produced for resale

    • regularly sell large quantities of items

    • sell similar goods over a longer period of time, especially new goods

    • frequently sell new items that you did not acquire for your own use

    According to case law, the following are indications of commercial activity:

    • operating an eBay shop

    • number of current sales: if many items are continuously sold over a longer period of time, this is usually a commercial seller

    • long-term, staggered sale of a private collection over many years

    • type of items sold (new or used goods, value): the sale of several similar navigation devices was classified as proof of a commercial activity – likewise the offer of 250 batteries in various sizes with reference to the availability of larger quantities.

    • a website or the use of advertising descriptions that create a professional impression

    Note: We regularly review our sellers’ trading activities and may ask them to mark their eBay account as a commercial account. You should also expect to be issued chargeable cease-and-desist letters by competitors or consumer protection associations and to face court action for injunctive relief.

    I don't know how high your limit is, but private sellers certainly don't offer a range of products and, on top of that, new goods like you do.

    Real private sellers offer unnecessary stuff they'd have lying around at home or maybe from clearing out a household...etc.

    However, you are clearly operating commercially and are not granting buyers their consumer rights.

    In that case, it's not necessarily the quantity of items that matters, but rather what's being offered.
