Reversal via the alleged button
Hi,
as already explained, the "NEW" returns process (here button or similar) does not work properly.
eBay does not send any notification or indication that a buyer has started a returns process (only the return request).
There is no proof of this !!
If a buyer puts the printout in with the return, it may arrive too late (i.e. after the 14+1 days).
So the returns process is invalid !
Now my question: who is liable ?

Hi Peter,
regarding your question of who is liable, I can only write my personal opinion that this is something courts will probably have to clarify over the next few years.
Whether the cancellation function implemented by Ebay complies with applicable law has surely been sufficiently reviewed by Ebay’s legal department.

there’s definitely no “couldn’t care less” attitude creeping in here.
The “new” cancellation function at Ebay still has some teething problems. The buyer no longer has to fill anything out here, just click to cancel. Unfortunately, as a seller, it’s hard to recognize that as a cancellation.
Though I personally wonder whether the form that used to be required even still complies with current legislation.
I had such a case recently and, after receiving the item, refunded the “customer” the purchase price including shipping. That was it for me.

Sure, everyone can do what they want, but unfortunately not before the law. We have obligations, but also rights. The buyer has rights, but also obligations. The revocation is still regulated

Hi Peter,
in the event of an audit, in such cases the corrected invoices from Ebay have always been sufficient as proof so far. They show the purchase price, shipping costs, refund, and the total amount.
Accordingly, that’s how it’s booked for me too.

as always, everyone can do what they want. However, there are certain rules 🥹 (It’s like with the invoices - discussion a few weeks ago) Classification as a document: A revocation is relevant for tax and accounting purposes, as it leads to a reversal of the transaction and invoice correction. Therefore, the declaration must be archived as part of the normal bookkeeping obligations.. Best, Peter

that only leaves maximum self-protection based on the invoices Peter mentioned and, if necessary, the return request itself + proof of transaction - what else do you want to do :)
Ebay could simply pre-create a cancellation form that is automatically filled out when the customer starts a return (personal details, order number, date, etc.). The cancellation is informal anyway and doesn’t have to be justified. The seller then receives this document by message/email and thus has the buyer’s declaration of intent on hand.
