Seller sells used item as new and unused

Hello everyone, I’m a bit concerned right now; I bought an €800 lens that was advertised as “new and unused” and with original packaging. The photos had the usual eBay low resolution / heavy compression and also seemed to match the description. What I received was a lens with obvious signs of use on the bayonet mount (typical of repeated removal and reattachment to a camera), minor scratches on the cap, and the lens on the camera side was smudged. The original packaging was missing, but an invoice was included. That invoice showed the item had been bought by the seller two months ago as a “demonstration unit” (display model aka customers can use it in the store). So it’s already ruled out that the lens could be unused, aside from the signs of use anyway. I don’t want to accuse the seller of anything, but that such a condition description is completely off for an item like this and would have been 100% obvious when listing it is, I think, clear. You also know whether you’re buying a demo unit or not... I’ve now confronted the seller and at the same time submitted a return request with the same explanation. However, he denies everything... Regarding the obvious signs of use in my pictures, he says he only sees a few scratches on the lens cap and he wouldn’t know what I might have done with the lens (?!) and that an original box wasn’t mentioned in the description anyway. After that, he sent the semi-useful listing photos again. TLDR: Since €800 is a lot of money, I wanted to ask here whether there’s any other option than sitting out the three days until you can open a case. Aside from the behavior, which in my opinion is just deliberate and fraudulent, I want the lens out of the house as quickly as possible and the €800 back... I also unpack all higher-value eBay purchases “by camera” and recorded what the condition was like fresh out of the package. Optional: Is there a way to report something like this? I find the seller’s behavior completely absurd given the clear facts. Kind regards

No payout since July – deadlines repeatedly extended

Hello eBay team, I am asking for support from a staff member who will review my case conclusively and arrange the outstanding payout of 2,130.98 euros. Since July, despite numerous contacts, I have repeatedly been referred to an “expert team.” Nothing has been paid out to date. The buyer wanted to cancel the purchase after payment. When I did not agree to this, he announced that he would involve eBay or PayPal if I shipped the PC. I sent it on July 7; according to DHL, it was personally delivered on July 10. After that, the buyer first reported that he had not received the PC. Due to the proof of delivery, this case was decided against him, and his appeal was also rejected. He then claimed that the PC could not be turned on. This claim is the reason for the current buyer protection case. The buyer did not contact me directly about the alleged defect. According to eBay customer service, the buyer was supposed to submit an expert report. The deadlines I was given were extended several times: first until August 13, later until September 3, and then expressly for the last time until September 20. I was repeatedly told that no expert report had been received. Nevertheless, the payout still did not happen. What is especially incomprehensible is that eBay meanwhile informed me in writing that the buyer protection case had been closed in my favor. After that, I was again told that the expert team would get back to me. Instead of any feedback, I learned that the supposedly final deadline had once again been extended to September 29. Even when I speak to customer service, I am told every time, in essence, that I should be patient and not worry, the case will be reviewed and decided in my favor. I do not get a concrete explanation for the contradiction between these statements and the repeated deadline extensions. Today, after more than two hours in the queue and in the call, I asked to speak with a supervisor. The call was ended without my issue being clarified or me being connected. A deadline is not there to pass without consequence and then be set again and again. I expect eBay to clarify the matter now in a binding way and to arrange the payout of 2,130.98 euros no later than the expiry of the now again (“for the last time”) set deadline on September 29. If no payout is made by then, I will contact the consumer advice center and take legal action. In addition, I will forward this case to every social media channel in Germany that I can find and that deals with legal issues or consumer protection, in the hope that this case will make very big waves. Another vague reassurance is not a solution for me. I can share the eBay messages and the DHL proof of delivery as well as the case number and documents for review via a private channel.

Suggestion for display status Delivered for mail items

Hello, I'm not sure whether I'm the only one with this problem right now, but I'd like to raise something here. I'm talking about the status " Delivered " for letter mail. If you can track these, which nowadays seems to be getting easier, I've noticed something. The shipment is already shown here as delivered when the item has been sorted in some letter sorting center and just hasn't arrived at my place yet! This has already caused problems for my father, because he never received his shipment but didn't get his money back either, because the seller simply relied on the status. Now I may be facing the same problem myself, even though the shipment is supposed to arrive today, it has already been marked as delivered since yesterday. Therefore I would recommend eBay to step in here and revise its system so that this doesn't happen and so that it can be handled better in the future, or so that no action is needed at all. Thanks And just as an aside. It would be good if the system also included processing times in the shipping time for all other delivery methods, because many sellers now have processing times of 3 to 5 days, and this is not taken into account, which is probably why many have already sent emails with the subject " Where is my item " or " Item not received ".

How does eBay come to such a case decision?

I wonder how cases like this are actually reviewed on eBay. The listing explicitly stated “registered mail.” However, the seller only sent it as a compact letter with basic tracking. The shipment never arrived. I pointed this out to the seller several times and also asked why it wasn’t sent by registered mail as stated. The seller practically didn’t respond at all. Instead, he kept adding the same tracking number over and over again — sometimes even several times in a row. In the tracking info, it still doesn’t say “delivered” to this day, only that the shipment was processed at the logistics center and was then supposed to go “out for delivery.” Nevertheless, the case was decided against me on the grounds that my communication with the seller showed that I had received the item. Yet I explicitly wrote several times that I had NOT received it. I’ve since filed an appeal. But I’m genuinely interested in how a decision like this can come about. Is the communication even read in full?

Warning: No seller protection with basic shipment tracking (letter/small parcel)? My experience!

Hello everyone, I want to warn you about eBay seller protection with basic shipping tracking (letter/parcels) and ask whether you’ve had similar experiences. This is about the case where a buyer reports an “item not received” even though the shipment was successfully delivered according to tracking. The background: A shipment was paid for by me on Aug. 11, scanned on Aug. 12, and according to tracking delivered on Aug. 13. Shipping was handled completely through the eBay shipping manager . As is well known, eBay has for some time promised full seller protection for DHL letter shipments with basic tracking (and since 01.08.2026 also for DHL parcels) if shipping was booked through eBay’s own shipping manager and the status says “Successfully delivered.” The reality: a trap for sellers In practice, this protection gives private sellers a false sense of security. As soon as the buyer opens the case and it is escalated to customer service after 4 working days, the following happens: Automatically, the system does immediately give you a positive rating for this transaction (“Order delivered on time and without issues”). Nevertheless, customer service decided the case in favor of the buyer . The absurd reasoning from support: “Since we cannot confirm successful delivery, we are now closing this case and will fully refund the buyer’s purchase price. To continue selling successfully on eBay in the future and benefit from our seller protection, I recommend that you always choose a shipping method with tracking.” The receipt madness: Before that, support had requested additional proof: “the original postal receipt showing the buyer’s delivery address. Please take a photo of the receipt.” I then uploaded the original PDF stamp with matrix code, tracking number, date, recipient and sender address. This document was not accepted . Apparently, support expects a printed DHL branch receipt, like the kind you only get with parcels. The fact that the tracking number is already permanently and automatically linked to the recipient address by the eBay shipping manager (and included in the matrix code) is completely ignored. Shipping to a different address is technically impossible with this label (with this tracking number). The shipment can only have arrived at the buyer’s address. Conclusion: There is NO seller protection with basic tracking for letters and DHL parcels! If the buyer claims not to have received anything despite the shipment status “Successfully Delivered,” the eBay customer service will refund the purchase amount + shipping costs to the buyer. And advise the seller: “To continue selling successfully on eBay in the future and benefit from our seller protection, I recommend that you always choose a shipping method with tracking.” The legal situation in Germany: As a private seller, according to the legal basis, I only have to prove: “sale by shipment between private individuals (§ 447 BGB)”, that I properly sent the item. In a sale from private to private, the transport risk passes to the buyer as soon as the seller hands the item over to the shipping company. If the buyer claims, despite proof of shipment, that nothing arrived, they cannot legally demand either compensation or a refund from a private seller. But, since when has eBay cared about laws!

Buyer claims the cards were fake.......am I in the right?

as the title already says, someone claims that the Pokémon cards I sold him a few days ago are fake. I have 8 invoices from well-known shops. There are no fake cards there. the case will be opened on 28.8 and then I’ll upload all the invoices. Is that enough as proof for eBay? I don’t want to end up not getting my money ? I got a shock today when I received his message.....

Bought new shoes at auction. Seller cancelled. Reason: I asked not to seal up the box of the collectible sneakers. Please put the box in a bag, or use a paper shipping envelope.

Morning to everyone reading this, I won a brand-new PUMA LaMelo Ball MB.01 Alien Safari for very cheap. (21.50) I was really happy about that at first. I collect this series. Collectors know that the sneaker box is important too. Especially this one, because it looks very elaborate. I’ve already had cases where the seller, to save money, simply sealed the outer box with brown packing tape and shipped the sneakers in it. The box was then no longer usable. I also offered the seller an extra 3 euros for a bag or something similar. Here’s my first email: Morning, I won your nice shoes. Please don’t put any tape over the box. I collect these models. And the box is important to me. Greetings from the North Sea coast, J.C.Becker. First response, he sells at unbeatable prices, and he can’t offer any special treatment. I’m not allowed to quote the original text because otherwise I’d be breaking the law. But the text was almost exactly like that. So I was annoyed and replied in the same friendly tone. My second email: Dear Sir or Madam, should the box be covered in any way by you so that it can no longer be removed without residue, we will rate you accordingly. Violation of § 434 BGB. As customers, we have the right to flawless goods; with shoes like these, that also includes the box. In the listing photos, it is in perfect condition, and I expect the same condition after delivery! If a seller tapes up the box of collectible sneakers in such a way that the original packaging is damaged, there is a material defect under § 434 BGB. For collectible items, the undamaged box is an essential part of the value. The dealer has the duty to hand over new goods undamaged. Collector item characteristics Signature series: The MB.01 series from PUMA Hoops enjoys cult status in the sneaker community. Unique look: The design combines the colors Green Glimmer, Pure Magenta and Hyperlink Blue with a spacey safari pattern. Limited release: Like many LaMelo releases, the shoe sold out quickly after its release on January 10, 2025, which increases collector value. Sincerely J.C.Becker. Ps . Should the shoes now happen to suffer damage, or otherwise no longer be available, I will... Here was SADLY THE END BECAUSE THERE WERE TOO MANY LETTERS. Unfortunately I didn’t notice, it was from 300…. By then I had calmed down, so I thought I’d better add something nice afterward. My third email: Addendum: I ask that you not take my response personally. But it should go without saying that one shouldn’t damage the box of shoes like these. Since I’ve just been through this whole thing elsewhere, I thought I’d write the seller just to be safe... HIS REPLY: We do not sell as a dealer, cannot comply with the request, to save money only shipping pouch. He didn’t even offer a collectible shoe, he has to cancel the purchase. That really made me explode! He calls himself (I think I’m not allowed to name him here) anyway, I think that’s it. So I’m paraphrasing the name as something like “UniverseOfSneakers” He sells all new shoes, all different sizes. After that response, I checked. And in fact it says private seller with him; I hadn’t even noticed that, and at first I assumed it was a company because of the name. By then another reply had come in, the purchase had just been canceled by him and the amount refunded. My third email: Then the usual, we have concluded a legally valid purchase contract. That he cannot unilaterally cancel the contract. And so on and so on… THE JOKE OF IT IS, I’M ASKING NOT TO TAPE THE BOX UP. He says there are no special exceptions and then says he always ships in a shipping pouch. THAT’S ALL I WANTED!!! I then naturally assume that his unbeatable low prices were probably too low in this case. 21.50 euros for new PUMA LaMelo Alien. And maybe the purchase cancellation suits him? Long story short. It goes back and forth, each side gets more worked up. In the end I list all the paragraphs he is violating. § 14 BGB § 3 para. 1, § 5 a para. 6 UWG § 5a UWG § 475 BGB § 312g in conjunction with § 355 BGB § 8 para. 1 UWG I had already dealt with that below at the asterisk. He twists himself into knots in his emails, acts like he’s super smart and keeps digging himself deeper and deeper into his own downfall. I say, you’re a dealer, you sell shoes, all new and for a while now, and always different sizes. No, he’s private, then yes, but he has a small business, I tell him he has to state that on eBay. He says he does, it’s all on file, including his tax number. Can’t be, why does it say private then? He doesn’t go any further into that. I tell him that I’ve had enough, I’m now reporting him for the numerous violations. He’s violating competition law, cheating his customers out of the statutory warranty and so on and so forth. His reply: he’s reporting me, I’ve already sold over 1,500 items. Little by little, the genius is amusing me; shame you can’t read everything he wrote. He constantly incriminates himself, and in writing too. He writes that I’m threatening him, I listed which laws he’s violating and told him to please register his shop officially on eBay. But OK, in his eyes that’s naturally a threat, I can understand that, even if he’s in the wrong. Where was I, ah yes, the thing about my over 1,500 sold items, which I actually only bought. I write to him that his threat was researched just as badly as everything else. I had also sent him this, for the sake of peace. I would have really liked to have gotten the nice sneakers after all; I’d almost forgotten about them.... Dear Sir or Madam, you don’t seem to have any idea what you’re selling. These shoes are collected. I have concluded a legally binding purchase contract under distance selling law. Should you not deliver, I will make a replacement purchase and charge you the additional costs. Should you not pay those, I will sue you. Including collection with the help of a bailiff. A shipping pouch is sufficient. I only asked you not to tape directly on the box, please. I don’t understand why you go on the offensive from the very beginning? I’m happy to send you another 3 euros so that you can take a good shipping pouch, or for your extra effort because you put the box into the pouch. From my ratings you can see that I’m always fair, I was just very annoyed by your first response. In any case, I will not accept a cancellation and will pursue it afterward with all legal means. Because even a private seller is bound by applicable law. Besides, clarifying this costs me nothing and will be very expensive for you. And I don’t want to argue. I hope you agree to an amicable solution. Sincerely, J.C.Becker. He then continued to threaten me, about my 1,500 sold items and that I myself would be bending the law. Under my few listings, I state that shipping risk lies solely with the buyer. THAT IS ANYWAY THE CURRENT LAW ACCORDING TO THE BGB. I only put it in the text again so there are no problems if once again one of the shipping provider’s employees has a bad day. I then sent him this as well. This exact addition is legally compliant. Yours lacks this addition. You are a small-business operator, (HE HIMSELF CLAIMED THAT IN HIS EMAIL) who appears as a private seller in order to bypass the statutory buyer protection. And your threats go nowhere with an honest citizen. As with all your other statements, the substantive context is missing here too. Because I have sold 64 items in 25 years. And not 1,500. And all this trouble because you’re upset about a purchase price that’s too low. And because you want to use my request for a bag or shipping pouch as a reason to cancel the purchase. Very sad. I still wish you all the best. Kind regards, J.C.Becker. So that was the gist of it, what do you think I should do now? Report him after all? What he’s doing actually violates a lot of paragraphs. On the other hand, of course many people are happy about cheap shoes, and I’d be taking that opportunity away from them. And this brazenness of the way he writes, his shamelessness, and his impudence really annoy me. I hope you’re not mad at me for going on like this with such a long ramble here and for wording it so casually…. Greetings from the North Sea coast, Jürgen. *The seller I MAY NOT NAME poses as an alleged private seller in order to bypass the warranty or right of withdrawal (so-called “disguised trader” or sham private sale), which is anti-competitive and contrary to consumer law. What matters here is not the eBay designation, but the legal definition of a trader under § 14 BGB and the prohibition of unfair competition under § 3 Abs. 1, § 5 a Abs. 6 UWG (concealing commercial identity / misleading by omission). Legal basis and paragraphs Trader status (§ 14 BGB): If the seller acts in the exercise of their commercial or self-employed professional activity, they are legally a trader – regardless of whether they tick the box for “private.” [ 1 , 2 , 3 , 4 ] Competition law & misleading practices (§ 5a UWG): Hiding behind a private seller identity is a misleading commercial practice by withholding essential information (consumers are deceived about their statutory rights). [ 1 ] Consumer sales (§ 475 BGB): A commercial seller cannot exclude warranty rights at all when selling new items to consumers, and only very limitedly for used items (reduced to one year, but not completely excluded) through terms and conditions or standard clauses. The classic exclusion (“excluding any warranty”) is invalid for traders. [ 1 , 2 , 3 ] Right of withdrawal (§ 312g in conjunction with § 355 BGB): In a commercial distance-selling transaction, the buyer always has a 14-day right of withdrawal, which cannot simply be excluded with the phrase “private sale / no returns.” [ 1 , 2 , 3 ] Legal consequences for the company The alleged exclusion of liability is legally invalid. The buyer is entitled to full commercial warranty and withdrawal rights. The behavior is subject to a warning letter by competitors or associations under § 8 Abs. 1 UWG .
