Sat tuner - bought used privately - is a return possible via buyer protection?
Hello everyone,
I bought a satellite tuner from a private seller.
When I had installed it in my receiver, I noticed that
one function that is very important to me did not work.
It is a special reception mode called Multistream.
After googling for a while, I then found out that there is a
old and a new version of this tuner.
But they cannot be distinguished from the outside.
The technical specifications on the tuner’s circuit board are even identical to newly offered models on the internet. If it were a dealer, I’d have a 14-day return right, then it wouldn’t be an issue.
I then contacted the seller right after receiving the tuner and asked for a return.
But he didn’t reply to me. What is the situation here with seller protection?
For me, the tuner is unusable like this, so my only option is to sell the entire receiver. Buying a new tuner would not be worthwhile. As I said, there was no way for me to know this in advance, because the listing photo is completely identical to that of a sat shop.
The only difference is that the sat shop even advertises the Multistream function prominently.
I think the seller knew this very well; he did not mention the Multistream function.

maybe it would help to write to the manufacturer or the German distributor and ask them for goodwill / an exchange / inexpensive B-grade goods.
Otherwise, put the item up for sale. It doesn’t have to be here.
Even if you lower the price a bit, it might still be worthwhile if you factor in the shipping costs and your future / already invested time.
Either way, taking some responsibility shouldn’t hurt you. It just went badly. Not all mistakes can be undone. See it as a lesson that each of us has had to go through at some point. It made me stronger. Since then I inform myself better, or rather in a different way.
Try to accept the past and look for solutions; don’t try to undo the past, but look ahead and find a future solution that suits you.

Why should I google the designation again when it says there that
the tuner with the label MOD2017/02 is multistream-capable?
Look at it the other way around, then you’ll notice that the wrong image in the shops is very often
used. If you’re looking for a triple tuner with multistream, then you enter that as a
search term. And not a designation that you don’t even know at that point.

·10 months agoI took the trouble to google the model designation on the seller's photo of the board: "Dreambox Triple Tuner MOD2017/02". All the sources I looked at show that this version does not support multistream.
If I can do that, someone like me who doesn't have the slightest clue about this stuff, then you should be able to do it too, right away.

OP10 months agoThe new version must have been available since around June 2017. The older versions had MOD2017/02 printed on the board. I found a tuner with a Multistream label and the note MOD2017/06 at a sat shop (link can be added later).
In any case, it's been a very long time already, and unfortunately I didn't know that. Because the manufacturer also didn't exactly make a big public fuss about it. Unfortunately, many sellers (including here on eBay) still have the old pictures up.
That's why I specifically made sure in advance with 2 shops that the tuner was only offered in one version or was manufactured that way.

So why should I ask the seller beforehand whether a function is available that is always part of the offer - including here on eBay.
But what worries me even more is that I have always written factually here - yet I was constantly being accused of things like accusing the seller of something or alleging fraudulent deception
And then I also get insulted.
At the same time, I always wrote that I was not accusing the seller of anything.
But I am allowed to have a personal opinion. Especially about a seller who offers almost nothing but sat tuners.
I actually know a board as a place for exchange - but I probably expected too much here.
A good seller would at least have responded to my request for a return.
But not responding at all is simply not okay.
If he had answered honestly, I probably wouldn't have even written here.
I just know trade differently!
Everyone can make mistakes, me too, but then you can talk about it.
And if I send a seller an email with a request - and receive no reply
that's just sad.
But enough said

If the seller did not describe the item in more detail, then according to the law the characteristics that can usually be expected from goods of the same kind are decisive. This means that, unless defects were expressly pointed out or the item was expressly sold as defective, the buyer may expect a functioning item free of defects.

·10 months agoYEEEES, if it's something important to me, I ask IN ADVANCE and don't try to blame the seller afterward and demand my money back.
As you yourself wrote, you didn't know that there are two different versions of the receiver.
But you assume your seller must have known because he sells stuff like that often?
That's not fair. You can always resell the device.... you also sell technical stuff often. 😎
Buyer protection can't apply here because there is no deviation from the listing, as eBay employee Nina already explained.

you have already been told here by an employee that the situation is unfavorable for you.
You can also assume that a note has been placed on this deal and that a buyer protection claim from you will be rejected faster than you can say amen in church.
You sell on the platform yourself, list the item with your account and a description that, in your opinion, matches it.
You also don't have to share any extra proceeds with the other seller.

So the seller is supposed to have known that exactly anyway and acted fraudulently? And the proof of that is that he didn’t mention the function that’s missing? I think that’s a very problematic argument if you don’t have any further evidence.

The reason you selected for the opened return is therefore not correct.
Misuse of buyer protection is not permitted on our platform. You received the item you also ordered.

Again, even if the seller didn’t know that the tuner can’t do Multistram and didn’t
mention it, there is a hidden defect here.
No one has to - or can - list all the functions of an article.
I have experience with that - I work in retail - and we have always exchanged items
that has already happened with notebooks, or cell phones, when the manufacturer has made changes.
And if something is then sold, revision1 / revision2 must be noted, for example.
And if that is forgotten/was forgotten and the customer picks the old model, the decision is made in the customer’s favor.
And I am an EBAY + member, I just checked and it says in the terms:
If you don’t like an item or something isn’t in order, you can return the item free of charge. This applies to all returns with standard shipping within Germany. Go to the item in your purchase overview select „Return this item“ and follow the instructions. You will immediately receive your free return label.
I don’t want to take anyone to task here, but I’m not giving money away either, and otherwise I’ll have the whole thing checked by a lawyer.
Then I’ll see whether I’m in the right - or not !

I would state the reason for return as "received the wrong item"
For me, this is a hidden defect, which is what they call missing information under German law.
A seller does not have to carry out all functions. But if, as a buyer, I have no indication
that it is an item that is not current - hidden defect

Which buyer protection would you even want to open? Item does not match the description? According to your own statement, the seller never said anywhere in the item description that the tuner is multistream-capable.
So far you have received what you bought. And like you, your seller may also be a "qualified" amateur who simply didn't know exactly whether the item supports "multistream". To know that, one would first have to know when the device was actually last used.
I had it last year with a used motherboard that the second graphics card slot was defective. But if the seller never used it, it is actually pointless to want to blame him for not having known. It is certainly possible that one person or another will thoroughly test all connection options, all slots, etc. when selling, for example, an older motherboard. But quite apart from the rather large effort, including in terms of time, since when testing you should completely disconnect the PC from power each time you change the configuration, not every seller has the right hardware to test with. And most simply assume that the item will be used in exactly the same way as it was used by the seller.
And therefore, if the seller no longer responds because he is glad that he has finally gotten rid of the thing and someone still paid money for it, then you will have to take it on the chin, for better or worse. Of course a seller should list all features of an item in detail in the item description; if an important property is missing there, however, it is your job as an interested buyer to ask the seller about the missing information or to steer clear of this offer altogether.
Closing your eyes and pushing through and hoping for the best has actually turned out to be the worst option in recent years, especially when buying privately on the internet.
If the seller takes it back voluntarily, good for you; unfortunately you are not entitled to that. And if an item corresponds 100% to the item description, it is actually not a buyer protection case either. Just because you made a mistake when choosing the item due to lack of knowledge. Sorry.
