With these reasons in the menu, eBay's answer will always be correct.

Oh yeah, if anyone still needs first aid kits for the car - the other guy naturally keeps on going as normal too, without anything being done about it. I don't care about all the edge cases at all, but at least go after the obvious ones..

Apparently reporting such sellers has no effect, but I am surprised that some internal process doesn’t automatically rule out listing such large quantities of identical items for a supposedly private account in the first place. Condition "New", identical items and high quantities and sales are actually the absolute trigger terms for distinguishing private/commercial.
All the automated stuff otherwise handles almost every little thing when listing and selling. The "quantity" field alone shouldn’t even be selectable for private sellers, or if it is, then limited to 10 pcs or something. That can’t be that hard from a programming standpoint … 🙄

·7 months agoin fact, before the introduction of free selling for private sellers, private sellers were allowed to list a maximum of 9 items per offer // multiple offer or offer with variants.

It couldn’t get any worse.
But as I said, in my opinion the buyers are also to blame.
As long as it’s cheap, they don’t care about anything else at all.

If Ebay's legal department checks it, it will probably just dissolve a collection. 😈
On top of that, there are also two spelling mistakes in the headline.

Honestly, I also say Verbandskasten and would have written it that way too 🤭
There are also quite a few offers with that spelling.
However, a Bratswurst wouldn’t end up on my plate, who knows what that is.
But then again, I find it strange that it’s called Blutstropfen, sounds wrong to me.

·7 months agoI wasn't even aware of the histories - but if so, shouldn't a change in category be noted there too, for example? I would have said it was always the same listing. I'm still somewhat indifferent to the offer, because it's not at all my product range, but if he really sold nearly 700 new items privately without complying with legal requirements, damn..
I rather explain the changes by adjustments to the best-before date; those probably changed over time, he surely didn't suddenly find 1000 new, valid bandage bags in the attic, did he?

·7 months agoNaja, für solche Kandidaten mit hunderten oder tausenden Angeboten, möglichst noch Neuware oder als "Varianten", wurden immerhin die berüchtigten DAC7- Obergrenzen in Anzahl und Umsatz eingeführt. Wir schimpfen ja alle immer gern auf die EU und unsere Steuerbehörden, aber das war richtig, um immerhin entgangene Steuern nachzufodern.
Ich kann mir auch gut vorstellen, dass die Behörden tatsächlich genauer hinschauen, wenn Ebay z.B. hunderte Verkäufe oder sehr hohe Umsätze meldet.
Nicht vorstellen kann ich mir allerdings, dass bei Ebay echt noch jemand persönlich Meldungen überprüft, die zu Schein-Privat/Gewerblich eingehen. Das werden zu viele sein.
Dass Privatverkäufer keine Gebühren zahlen müssen, halte ich (privat) auch für unfair. EU-weit fallen zwar 5% ein, aber das ist nichts im Vergleich zu den extrem hohen Gebühren auf alles, die Gewerbliche zahlen müssen.

I can only underline that. The KI (Kleine Intelligenz) now takes care of that for the Ebay staff. Luckily, otherwise our dear ones would no longer be available here in the forum.
Right now we live in a world that’s turning the processes here on the internet completely upside down and leaving bewildered users behind.
But as they say in a well-known sci-fi saga: "I'll be back".
Hopefully Arnie will come soon and save us from this "crazy" machine

·7 months agoBecause many of the pseudo-private sellers will surely comply with their tax obligations from a financial point of view.
It’s simply about eBay tolerating this behavior and preventing fair competition.
But apparently they generate enough profit through the ads that they see no reason to respond here.
If all commercial sellers were to set these ad campaigns to 0 for a certain period of time, I’d be curious to see eBay’s reaction.
I don’t understand anyway why merchants, when such "new features" are introduced, let themselves be harnessed to the cart like that and jump on board right away.
It should have been clear to everyone that this would become an upward spiral.

I recently talked about this with a fellow dealer (category: decor / household).
A commercial seller had been reported several times, as is always preached here, but nothing happened and every time it was: "The bid does not violate our principles."
Then he wrote to the seller that no normal private individual owns so many "decor/household items" still in original packaging and that they should please stop doing this or register a business.
Then came the bombshell from Ebay not even 5 minutes after he sent it.....
....I couldn't believe it, I was stunned when I read that.

Because this applies here too: it's all in the tone, and that also affects Ebay's reactions.
In general, with such reports, try to stay as objective and emotionless as possible.

But the real kicker is and remains: eBay just watches and does nothing - not even after repeated reports.

Yes, in my opinion you can already speak of fraud here, because the commercial sellers are cheating the customers out of their consumer rights, and doing so deliberately and with full intent!
Possibly they are also cheating the general public, that is, the tax office, out of tax revenue.
At the very least, though, they are cheating Ebay by not paying listing fees, which we commercial sellers have to pay.

And that’s only because ebay unfortunately allows it!
Reports go nowhere and when someone does respond here, it’s always the same empty phrases. They may well be reviewing it, but nothing is being done.

·7 months agoBut all the buyers of these "private" sellers don't seem to be bothered by it in the slightest.
It always takes two to tango.
Only when there are problems do they suddenly come to the forum with "supposedly private seller" or "private seller who is actually trading commercially" and complain when they then have no consumer rights.
I don't believe that it only becomes apparent when problems arise; these buyers know very well what they're doing.
And honestly, if those being cheated didn't mind being cheated beforehand, why should I care when they end up having trouble afterward.
That Ebay tolerates this is, for me, one of the great mysteries of the universe, when otherwise they're after every cent like the devil after a soul.

In principle, I completely agree with you.
However, I do believe there are buyers who don’t realize WHO they’re buying from and what that means in the event of a claim.
But it’s the same as with buyers of Chinese goods - my sympathy there is very limited.
If you don’t inform yourself beforehand and/or knowingly take the risk, then you shouldn’t complain afterwards!

Well, what can you say about that. Thoughtless buying, over a phone (mobile), of course with an app (apparently there’s no other way anymore), someone will surely catch me when I fall, ....
Just like every year, animals end up under the Christmas tree and by the next vacation at the latest in the animal shelter (at best).
People have been preaching this for decades and it doesn’t help.
People are getting dumber and dumber because more and more is being taken off their hands, because more and more others are being pushed into responsibility instead of relying on personal responsibility.
Federal Youth Games are being abolished because they don’t want to subject the poor children who aren’t the best to this incredible humiliation psychologically.
Strengthening ambition, motivation, power, belief in yourself, commitment, getting stuck in, comparing yourself with others and realizing that you’re not the center of the universe after all — all things that won’t be in demand in the future anymore. At least that’s what certain people think.
In China it’s exactly the other way around. Anyone who doesn’t put in as much effort as, well, hardly any child, certainly not here, won’t amount to anything there.
The ones who have made something of themselves are already far ahead of us and will be miles ahead of our future generations.
And that’s already how it’s going.
Well, I’m going off on a tangent again, sorry ....

Hey Andy,
on the first point, I absolutely agree with you: on the first point, commercial sellers who present themselves here as private customers are cheating their customers by withholding the rights they are legally entitled to.
Whether they are cheating the general public by withholding taxes can be judged not by us, but only by the competent tax office.
And whether eBay is being cheated here is debatable. The fact that eBay at least allows this kind of business practice, even though the evidence is clear, could indicate that the financial benefits for eBay (many sellers increase the platform's attractiveness) are greater than the financial disadvantages (lost fees). And only a court can decide that in an individual case.
