Buyer - entitled to deduct input tax abroad in the EU, why can’t the sellers issue invoices
I want to buy an item in the name of my company (EU foreign company based outside Germany) as an entity entitled to deduct input tax under the EU reverse charge system, at the net amount, which is common practice in the EU. The seller of the item here on eBay says that it cannot be sold on eBay without VAT. That cannot be right. Please reply.

Hello @levci92 and thank you for sharing your wish with us here. I have moved it to the designated community area for this, since this is a suggestion for improvement that I have passed on accordingly.
At present, it works in the category "Business and Industry" and for Collection and remittance-transactions (there are none within the EU) so that net prices are shown to you when you use a business eBay account for your purchases.
Transactions that do not meet these conditions must currently be corrected manually by your sellers or you can have the tax reclaimed through your tax advisory office. Your request has been received. We hope that in future it will be possible in more categories to better meet your needs regarding input tax deduction.

OP2 years agoAnd to which law is Ebay.de bound, with which company headquarters? Or is that, as usual, regulated through oasis states. If business is being conducted in the EU, then please by EU law. We know all too well where the taxes at Ebay, Apple, Facebook, Meta, etc. end up.

·2 years agoThat is in line with EU law. A merchant from outside the EU can supply goods free of VAT, but that is not mandatory. Ebay has not implemented this route, so the merchant cannot use it via Ebay. So you have to get the VAT reimbursed by your tax office, which is no big deal anyway.
And as for the double work or wasted time: In the time it took you to write your last posts, you could have entered the amount into the advance VAT return three times over. Or put the invoice on the stack for the tax advisor – that's what I always do and it doesn't take me two seconds.

Yes, that can be correct, because net purchases are not предусмотрено here on Ebay.
If the seller does not charge tax, Ebay does that.
But that’s not a problem, because you can get it back from your tax office.

this is double work for everyone involved, which is why the REverse Charge system exists in the EU to avoid exactly that.
