Complaint eBay
I ordered something on eBay in June, a lawn tractor. After 3.5 operating hours I contacted eBay because it was not running properly; they told me the seller had to arrange a pickup. It was packed up and then collected on 30/07, and on 01/08 it was delivered to the seller with completely different pictures than the ones we took before pickup. Then I contacted eBay, provided all the proof, and they said they would get back to me, which also took a few days. We also reported the return to Klarna; then all of a sudden eBay was no longer responsible and I was told to contact Klarna from now on. Now yesterday was the worst: eBay is now claiming that no return ever took place, and Klarna is now continuing the payment. Not only does the seller have the full purchase price plus the lawn tractor, NO, we are supposed to pay maintenance costs too.
We have messages in eBay between the seller and me that show he has his item back, we have the tracking number, everything can be proven, and we are now being harmed twice over

We have two different situations here.
The text above refers to the return, which was automatically and correctly closed because you opened a payment dispute. This means we as eBay are out of it and unfortunately no longer have any recourse. It doesn’t matter here whether you sent the item back or not.
Now comes the second situation.
You opened a payment dispute with your payment provider. They informed the seller, and the seller responded accordingly.
After reviewing it, Klarna decided to side with the seller, even though the seller confirmed that they had returned the device. You can only get more details from Klarna.
Try to find a solution with the seller so that they can send the device back to you.

OP8 months agoApparently, we did not send back the lawn tractor, although Ebay received all the information proving that it arrived with the seller.
But very good that Ebay accepts this and lets him sell B...
He has the full purchase price, the item, and wants to claim repair costs
I no longer have to communicate with the seller; it's with the lawyer!
But what Ebay claims to Klarna is the really bad thing about this

- tractor was picked up - you have the transport company's paperwork for pickup, return, and delivery to the seller?
- you took pictures before/during pickup?
- the thing arrived with the seller?
- the seller received something else (according to their pictures)?
- the case was opened with Klarna - eBay is out of it and anyway not responsible for warranty and consumer rights
- Klarna decided against you, even though you could prove the return?
- What exactly is your seller saying?
You and your seller have a contractual relationship. You and Klarna do too. Klarna wants money first in all this mess. You can then reclaim that from your seller.
Either communicate directly with the seller or get a professional (lawyer) involved.
We here are all laypeople, can’t give legally sound advice, and only know your side of the story (usually with half of the actual process).

OP8 months ago- did you take photos before/during pickup? Yes, exactly once before pickup and once when the freight company loaded the lawn tractor
- did the item arrive with the seller? Yes, he confirmed it to me in the messages on Ebay
- did the seller receive something different (according to his pictures)? Yes, according to him the lawn tractor was only on a pallet
- the case was opened with Klarna - ebay is out of it and in any case not responsible for warranty claims and consumer rights
- Klarna decided against you, even though you could prove the return? Yes, because based on the pdf from Ebay saying that the item would still be with me and that a pickup had never taken place, Klarna decided against me
- What exactly is your seller saying? He is lying in the PDF file too, we would have agreed to a reduction in the purchase price, but that was discussed in the messages, he wants repair costs. If we want the item back, we should drive over 400 km one way.
As I said, he has the item purchase price and wants the repair costs

So the seller says the claimed damage was caused by you? Because if he is demanding repair costs, he is surely claiming that the fault/damage occurred with the buyer? If that were the case, Klarna of course has a claim to payment of the purchase price, the seller to repair costs, and the return shipping would also be chargeable and would have to be paid by you.
You and the seller can’t come to an agreement, so go to a lawyer and have it sorted out properly and securely there, whether it’s warranty, damage, or whatever. Alternatively, pay for the repair and return transport.

unfortunately @perfect-sally is right there, it looks like all the deadlines have probably expired, you let yourself be kept on the line for too long.
What surprises me a bit, though, is why did you get an English reply - was it a purchase abroad ?
Besides, the reply claims that you got the tractor back again and that there is proof of delivery for it !
Sorry - but I’m afraid no one can really help you here, the Ebay employees probably won’t be able to do anything either.
But @miriam@ebay might want to take a look at it !?
To me, though, this looks more like a case for a lawyer !

·8 months agoAnd what would you like to know? On eBay, all deadlines have expired and eBay can no longer help. You’re talking about July and August, and now it’s the end of October. You have to stay on top of it and not let yourself be put off.
