eBay Retoure Label

I received a free eBay Retoure Label to ship back the item I bought from my buyer after I recognized some problems on the device after two.
But since I sent the item back on February 21,2019 I haven't received any refund from my seller.
So is it possible for me to take legal action against eBay in this case?
Because it's eBay that asked me to send the item back to my seller.
I mean eBay is making me to lose both ways because I didn't get my money back and I don't have a item with me.
Please I need your advices.
