Hello and thank you for reading. Please forgive me for writing in English, since I am an unexperienced/slow writer in German.

Yesterday I listed three <5mW Class IIIa red laser pointers. I list all my items to be sold internationally. Before finaly listing them I was warned they I might be breaking certain rules/laws/policies, but I listed them anyway. After that I went checking how selling of laser pointer devices is regulated. When I found out to which countries I am not allowed to sell my laser pointers (UK, Sweden, Netherlands, ..., they are all mentioned in an article in Wikipedia) and wanted to correct my listing by making an exclusion list for these countries, I was unpleasently surprised, since my listing was already removed and I have received the following message from eBay:

Since I am not allowed to make any replies to the received message, would someone please tell me if my listing would have not been removed if I would create the exclusion list for countries to which I am not allowed to sell my laser pointers when publishing in the first place? So to ask the same thing in other words, if I would comply to the rules that regulate selling these device when publishing the listing, would it really make any difference?

I was reading that Amazon is banning listings like that if you comply to rules or not, becouse they have agreements with certain sellers who can sell such laser devices, and if you do not have such agreement, they automatically remove your advertisments or they do not allow you to publish such add in the first place. I don't know if the same policy is practiced from eBay.

If the before mentioned policy is not practiced from eBay, if I list my laser pointers again and this time make an exclusion list, will this suffice or is there anything else I should do/pay attention to?

I will be very grateful for all your answers/comments and time you will sacrifice for me.

Since I couldn't edit my original message, I am extending it with the following comment.


I have just found a listing for Red laser with power of over 250 mW that is being listed under Presentation devices (
Büro & Schreibwaren > Präsentationsbedarf > Präsentations-Zubehör > Laserpointer).

The listing does not omit selling the laser pen to the before mentioned countries to which only 1 mW laser pointers can be sold.

I have made a report to eBay. Interesting by reporting items to eBay is that options are very omitted. You can't report that forbiden/partly forbidden energy weapons are sold. I saw no option for eBay policies breaking/partly policies breaking. You can't add any comment.

Why did eBay not remove this listing, but mine was removed imidiately?

you are not allowed to sell laserpointer with more than 1mW on Ebay.de.

thank you for pasted eBay statement, that explains most things, at least as much as my listing is concerned. Like I have said already, required specifications when creating the listing would solve most problems. If anyone would input false informations, would be banned from eBay. I wouldn't say that if laser pointers woudn't have a specific section when you choose in what sections you will list your selling item. But they do, since they are treated as weapons and dengerous tools/toys these days. eBay is not treating them as weapons yet, but they should. If they would treat them as weapons, no laser pointers which power exceeds 1 mW would be found on eBay. I found one seller while doint a quick search who is selling a laser pointer with power of over 250 mW and has sold two pieces from five already. All I could do was to report eBay that this laser pointer was listed in wrong section. I did not found any other possibilities to complain about and I took myself time to go all complain sections through. I am not a experienced German writer, but my understing is not bad. Otherwise I wouldn't have chosen German eBay for my primary eBay account. I hope you all agree with all I have said. I don't like complaining, complains or to speak out loud are two different things.

I don`t know it exactly your situation. Your article is located Slowenia (or another country) and you offered it for ebay Germany, too? That`s what I read in the message from ebay.

Laser Pointer offerend for germany must have a CE-marking e.g. https://en.wikipedia.org/wiki/CE_marking

Maybe your article has one and the ebay descision is subjective or because of your description. In any case you shuld respect the descision. I think it does not make big sense to clear if you are allowed or not with the customer service. Your account is under observation and would be suspended if you try it own your own to offer again.

thank you very much for your comments and informations. I have not seen any declaration for the laser pointers I was trying to sell that they are are in compliance with the relevant EU legislation applicable to this product. They are not CE labeled.

It's a shame, since eBay has a specific section for laser pointers to be sold, as a seller you are not offered to input any parameters for the laser pointer, like power, laser class, CE conformity, ... If eBay would demand such specifications to be input, the listing could have banned automatically. I would look at such approact as very positive.
