Hello, i am a seller based in Portugal, who has listings in ebay.DE. I have tried talking about this via ebay chat to both ebay.com and ebay.de but both were useless.
Basically i am registered as an individual businessman, and for every sale i make, lets say for a 20€ item, as does everyone else, i pay a fee to ebay, say 3€. Ebay charges on top of this fee, VAT from my country (23%).
From what i talked to, both to local accountants and my local tax office, this ebay fee is a service that i pay to ebay, and from they told me, according to EU law, service transactions between businesses are not supposed to be taxed VAT on, and declaring and deducting VAT is meant to be done by me to my countries tax office.
My tax office doesnt let me deduct VAT from this transaction as its a service, and i can only do it on transactions of goods, so im not sure what to do here. Other selling platforms such as shopify dont charge VAT on top of their services, as is the correct thing to do, so i am completly at a loss on what to do here. It might be a little value but i work with fairly small profit margins, and this is literally money thrown out the window incorrectly, and ebay has proved to be useless in helping, saying they literally cant do anything.
Any advice?
