Seller requesting legal action

I recently bought a used graphics card from a fairly reputable seller, and once installed in my computer, it started to crash under heavy load. The temps shot up and it was overheating, so I let the seller know about it. The seller insisted the card was completely fine, so to make sure it was fine I tested it in another pc, and it had the same results. I filed a refund and return request for the card, and sent the seller a message to let him know of the situation. His response was along these lines: “The card was 100% working, and I have witnesses. I do not sell defective goods. I suspect that it was a miscarriage of them when I recall the first email. I have no other choice but to print the emails, hand them over to my lawyer tomorrow and report them to Ebay. From now on there is only contact through my lawyer” (this is a simplified translation from german). So what am I supposed to do? Obviously I want a refund, since I payed 130 euros. I do not want to get involved in a legal case. I payed, he sold me a faulty card. I should be entitled to my money back, no? I payed with credit card, so he could either just give me the refund or I could take it to my bank and get a refund that way. Regardless, advice on how to deal with this stubborn seller would be appreciated.

Do you live in the States? Was the shipping address in the States?
