Seller doesn't want to send item or refund. Payed with bank transfer and no ebay protection active ?

Seller doesn't want to send item or refund. The item is a new phone, from a private seller.

I payed with bank transfer and the money arrived. Seller told me he will send the item after 1 month, but i want the item send sooner or order canceled.

But the item does not have ebay protection which is nonsense and i see the seller re-listed the item.

How should i proceed ?

Where does the seller came from ?

Did you check IBAN number on Google ?

First, the seller wrote : Shipping only to Germany.

Second, Shipping due to sickness by end of November.

Did you give him a German shipping address ?

I gave him my german address, there is no problem there.
My german was bad and i didn't read the description correctly. I can't understand why you will list an item if you are ill and can't post 1 month, while having 3-4 more listings which you can post?
The other strange thing to me is that the order is not covered in ebay protection.

There is no address there, but a message from the seller that the shipping is going to be late, which was not transfered to my ebay app( very buggy ebay, i see now why he was a bit aggresive in his messages)
